- General conditions of sale
"the salesman and the purchaser agree to subject the present
sale at the following general conditions, that the purchaser expressly
states to have included/understood and have accepted, including with
regard to the obligations described with art. 5, extension of for
contained in article 7 and the election of right of art. 8.
Article 1 the products presented on the site of the salesman are not
exactly faithful as for their size, their color or any other
appearance, with the products which can be ordered.
Article 2 the salesman is not bound by an unspecified obligation
before the reception by the purchaser of an electronic message of
confirmation on behalf of the salesman, envoy to the address e-mail
indicated by the purchaser in the form of command.
The salesman reserves the right to refuse unilaterally and without
explanation a command, or to take action pursuant to it only partially
if this one relates to several units.
In the same way, it reserves the right to modify unilaterally and
without notice the prices like any other condition of sale.
Article 3 the forwarding of the ordered products intervenes in the 2
working days which follow the sending of the message of confirmation
of the salesman, by the means of postal routing and with the address
of delivery indicated by the purchaser in the form of command.
All the risks pass to the purchaser at once that the goods are given
to the Swiss post office or a deprived conveyor in Switzerland.
Article the 4 total prices of the command indicated on the form gets
along fresh and taxes of forwarding included/understood. The taxes of
importation, customs and any other administrative tax perceived in the
country of delivery are the exclusive responsibility of the purchaser.
Article 5 the purchaser is only responsible for all the steps
necessary to the importation of the goods on its territory in
accordance with the right in force.
It certifies major being, to have the right and the capacity to order
the goods, to have gotten information beforehand to make sure that
this command does not violate any provision of the right in force in
the country of delivery or residence of the purchaser and that all the
provided information is exact.
The salesman excludes any responsibility rising from a nonconformity.
Article the 6 goods are sold with any other guarantee that that of
manufacturing.
Article the 7 All disagreements which can be born from interpretation,
the execution, the inexecution, of the bad execution of the contract
by the parts will be exclusively distinct by the courts of competent
jurisdiction of the canton of Geneva.
Article 8 For all questions having milked with the present contract
and its execution, the Swiss right is exclusively applicable.
